Welcome to THUSO. These Terms of Service ("Terms") are an agreement between you and THUSO VAULT (Pty) Ltd ("THUSO", "we", "us"), a company registered in South Africa, governing your use of thuso247.co.za, app.thuso247.co.za, and related services (the "Service").
By creating an account, you agree to these Terms. Please read them — especially sections 4 and 5, which explain what THUSO is and is not.
1. What THUSO is
THUSO is a family clarity and personal safety platform. It helps you:
- Store and organise important information (policies, documents, assets, trusted people, health information, legacy messages) in a private digital vault
- Understand your family's preparedness through your Clarity Score and AI-powered insights
- Alert your chosen emergency contacts with your location if you trigger HELP (Thuso Guard)
- Pass chosen information to chosen people under safeguards you control (Legacy Plan)
2. Your account
You must be 18 or older and provide accurate information. You are responsible for keeping your login credentials secure. We strongly recommend enabling two-factor authentication. Notify us immediately at support@thuso247.co.za if you suspect unauthorised access.
3. Plans, pricing and billing
Free plan — R0: basic vault (limited items), one trusted person, dashboard access.
Premium plan — R59 per month (or R590 per year): unlimited vault items, unlimited trusted people, AI Clarity Advisor, AI Document Scanner, AI Coverage Insights, Thuso Guard (including the panic feature), Legacy Plan, Health & Wellbeing, and priority support.
Payments are processed securely by PayFast (Pty) Ltd. We do not see or store your card details. Premium is billed in advance and renews automatically until cancelled.
Cancellation: you may cancel anytime from Manage Subscription. You keep Premium access until the end of the period you've paid for; no further charges follow. Your data remains in your account on the Free plan limits.
Refunds: if something goes wrong with billing — a duplicate charge, a charge after cancellation, or a technical error on our side — email support@thuso247.co.za within 14 days and we will refund it. Because Premium is billed month-to-month at R59, we do not refund partial months already used, but we will always fix genuine billing mistakes promptly. Nothing in this policy limits your rights under the Consumer Protection Act or the Electronic Communications and Transactions Act.
4. Important: what THUSO is NOT
THUSO is not an emergency service. Thuso Guard alerts the personal contacts you chose — it does not contact the police, ambulance services, or armed response. Alerts depend on your device having internet connectivity, location permissions, and your contacts receiving and acting on the alert. In a life-threatening emergency, always call 10111 (police) or 112 (from any cellphone) first. You must not rely on THUSO as your only means of summoning help.
THUSO is not a financial adviser, insurer, or financial services provider. Coverage insights and AI responses are educational information to help you organise and understand your affairs. They are not financial advice as defined in the FAIS Act. For advice on financial products, consult a licensed financial adviser.
THUSO is not a law firm. The Estate Guide and related content are general information about South African processes, not legal advice. We do not draft wills or administer estates. For legal advice, consult an attorney.
THUSO is not a medical service. Health & Wellbeing features help you store information and remember check-ups. They are not medical advice, diagnosis, or treatment.
5. The Legacy Plan — your instructions
The Legacy Plan releases chosen vault items to your chosen legacy contacts only according to the safeguards described in the app (check-ins, grace periods, and notifications that give you the opportunity to stop a release). By enabling it, you instruct us to act on those rules. You are responsible for keeping your legacy contacts and check-in settings up to date. A release made in good faith according to your configured rules is a release you authorised.
The Legacy Plan organises and delivers your information; it is not a will and does not transfer legal ownership of any asset. Your estate remains governed by your will and South African law.
6. Your content
You own everything you store in your vault. You grant us only the limited licence needed to store, display, and process it to provide the Service (including AI features you use). We do not sell your content or use it for advertising. You are responsible for having the right to store the content you upload.
7. Acceptable use
You agree not to: use THUSO for unlawful purposes; upload malicious code; attempt to access other users' data; abuse the panic feature with deliberately false alarms; resell the Service; or interfere with its operation. We may suspend accounts that breach these Terms, with notice where reasonable.
8. Availability and changes
We work hard to keep THUSO available, but no online service can guarantee uninterrupted operation. We may improve, change, or discontinue features. If we discontinue the Service materially, we will give you reasonable notice and the opportunity to export your information.
9. Liability
To the extent permitted by South African law (including the Consumer Protection Act): the Service is provided "as is"; we are not liable for indirect or consequential damages, or for losses arising from events outside our reasonable control — including network failures, your device's settings, or an emergency contact's failure to receive or act on an alert. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for gross negligence.
10. Privacy
Our Privacy Policy explains how we handle your personal information under POPIA and forms part of these Terms.
11. General
These Terms are governed by South African law. If any provision is unenforceable, the rest remain in force. We may update these Terms; material changes will be notified by email or in the app before taking effect, and continued use after notice means acceptance.
